CONTRACTURAL OBLIGATIONS


Terms and Conditions regarding Use of Website www.atc-cy.com for Andy's Telecom Centre Ltd ( ATC)  

1. ATC website is available as a free service. User registration is required.

2.  VAT AT THE CURRENT RATE OF 19% IS INCLUDED IN ALL PRICES .

3.  ORDERING PROCEDURE

You can order any item from our On-line Shop and we will deliver it to your nearest delivery point. Just follow the following simple steps and before you know it your purchases will arrive..

a. Choose from our Main Menu the Product Category from which you would like to purchase items, and then just click on the Add to Cart button next to the item you want to purchase. Your chosen item has already been placed in your Cart.

b. Then you can continue with your shopping or choose a delivery option, accept the Terms and Conditions and click the "Send Order" button. The login page will then open, where, if you are already a member of our On-line Shop, you must simply submit your username and password; otherwise you can register at this point. New member registration is easy and will only take a few seconds.

c. Before you complete your order you will be able to go to your account and make any changes you like to your personal information. You will also be able to change your order's content, like delete one or more products from your shopping cart, add more products or increase or decrease the quantity of the selected products as explained in the “Withdrawal and Cancellation Sections''.

d. Next, you will be redirected to a page where you will choose a Shipping Address and then click the "Send Order" button.

e. You are almost done. You will now perform a final check of your order and click the "Proceed your Payment with Papal ". You will be immediately redirected to the secure page of Pay Pal  and after your successful payment the system will redirect you to our website. You will then receive an email confirmation with your order details and an invoice of your payment. After that, all you have to do is wait for your order to arrive at your doorstep.

Our system will save your order in your Μember Account, where you will be able to review and check your current and old orders as often as you like.

4.  Delivery /shipping.

 All products will be charged at the rate of €5 /kg for delivery using Akis Express,ACS or  Kronos delivery points within Cyprus.If you live in a different country please contact ATC asking for a quotation to ship to your country. 

5.  CANCELLATIONS

You can cancel any order within 14 days from the day of receipt of  the items only by sending a written notification with your order details to our support department requesting cancellation. This means that you can return it to us in its original condition within 14 days of the date you cancelled the item, unopened with all seals, packaging and shrink-wrap intact and we will issue a full refund or credit note for the price you paid for the item. 

Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error, or if the item is faulty. Please package the relevant item securely in at least the packaging it was received and send it to us with a copy of your invoice .

Please note: we can only accept the return of opened items if they are faulty.

· Claims for damaged goods must notify within 24 hours of receipt, please inspect goods immediately. 

· Signing for goods accepts the goods into your care, and that they have been received complete and in undamaged packaging. You have the right to refuse damaged or incomplete parcels.

· We do not deliver to P.O.Box numbers

 

6.  History of Transactions.    Please note that ATC will keep a record of all transactions for a period of 3 years.

7.  Language of Communication   ATC will conduct all its business in the English Language.Please ensure that should you wish to communicate with us it must be in the English Language. 

8.  Which Law Applies to ATC Business   The law that applies to all ATC transactions and business will be that of the Republic of Cyprus and the European Economic Community including The Consumer Rights Law no.133(1), 2013, Section 8 implemented from 13/6/2014 (http://www.go-e.mcit.gov.cy/mcit/trade/go-e.nsf/eco21_gr/eco21_gr?OpenDocument), Information Society Services law 156(1)2004 and Amendments N.97(1)2007.

9.Withdrawal

 During your order procedure and prior to your payment through JCC or Pay-pal you will be able to remove part or all of the products from your shopping cart by pressing the Delete button which is next to each of your products in your shopping cart. You will also be able to add more products or change the quantity of the products in your cart.

If you choose to pay though Pay Pal and wish to cancel your order once you reached the payment page you can press the "Cancel and return to ATC website" button.

10.  Complaints Procedure
The customer has the right to return any product purchased provided they send a written explanation within 14 days of receiving the product to the MD of ATC. . ATC is located at the address shown in the ‘Contacts Us’ section of the website.

11.  Warranty / Faulty Products
ATC –CY.COM guarantees all products for a period of one year but makes no warranty, express or implied, as to its services in connection with the Internet, use thereof, or the accuracy or correctness of any information available through ATC –CY.COM including, but not limited to, any warranties or merchantability or fitness for any particular purpose. ATC-CY.COM exercises no control whatsoever over the information from the Internet passing through it.

If a product develops a fault during the warranty period, the purchaser is responsible for bringing it to the ATC premises along with its invoice before the expiry of the warranty period. ATC will make its utmost endeavours to arrange rectification of the product or replace the product whichever option is decided by ATC.

12.  Technical Support
ATC has at its disposal a range of Engineers each specialising in their field of expertise. Most faults are repaired by them. This applies to products sold by ATC as well as those purchased elsewhere.

13.  Code of Conduct
While using the ATC Site you agree not to:
* Restrict or inhibit any other visitor or member from using the Site, including, without limitation, by means of "hacking" or "cracking" or defacing any portion of any of the Site;
* Use the Site for any unlawful purpose;
* Express or imply that any statements you make are endorsed by us, without our prior written consent;
* Transmit (a) any content or information that is unlawful, fraudulent, threatening, harassing, abusive, libellous, defamatory, obscene or otherwise objectionable, or infringes on our or any third party's intellectual property or other rights; (b) any material, non-public information about companies without the authorization to do so; (c) any trade secret of any third party; or (d) any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communication (except as otherwise expressly permitted by us);
* Engage in spamming or flooding;
* Transmit any software or other materials that contain any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component;
* Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;
* Remove any copyright, trademark, or other proprietary rights notices contained in the Site;
* Frame" or "mirror" any part of the Site without our prior written authorization;
* Harvest or collect information about Site visitors or members without their express consent; or
* Permit anyone else whose account or subscription was terminated to use the Site through your subscription, username or password.

14.  Use of Service
The Subscriber agrees that the ATC website shall be used solely for Personal, Business or Institutional use as accurately represented by Subscriber. Subscriber agrees to truthfully represent the nature of Subscriber's use. Subscriber shall not directly or indirectly transmit, broadcast, redistribute, forward or deliver the Service or any part of the data, information, images or other products which constitute the service to any other person or entity, in any format, or by any means.

15.  Events beyond ATC LTD’s Control
ATC-CY.COM shall not be held responsible for any failure or malfunction in power or communications nor the failure or refusal of third party transmission intermediaries to perform, continue or renew their contractual arrangements with ATC-CY.COM, nor inability to perform occasioned by such or by labour strife, war, power outage, server failure, riot or other events beyond the control of ATC-CY.COM. If the Service or delivery thereof is disrupted by any such event(s), ATC-CY.COM obligations hereunder shall be suspended during the period of occurrence for such disrupting event(s).

16.  Limitation of liability
In no event shall ATC-CY.COM be liable to a customer for any indirect, special or consequential damages or lost profits arising out of or related to this indemnification agreement, 

the performance or breach thereof, or the accuracy or correctness of the information available through ATC-CY.COM. Neither ATC-CY.COM, nor its affiliates, suppliers, advertisers, affiliates, or agents or sponsors are responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to the Site and/or content contained on the Site, or any product or service purchased through the Site. Your sole remedy for dissatisfaction with the Site and/or content contained within the Site is to stop using the Site. The sole and exclusive maximum liability to company for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access the Site.

You agree to indemnify, defend and hold us, our officers, directors, employees, agents and representatives harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; (b) any allegation that any materials that you submit to us or transmit to the Site infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (c) your activities in connection with the Site or any services related to the Site.
